A new chapter begins.

I am delighted to introduce my new column with The Monday Chronicle :The Business of Influence: Intellectual Property Law.

For our very first article, I write on “Commercialise Botswana Government IP” exploring a question I believe deserves serious national conversation: when Botswana’s identity generates commercial value, who captures that value?

I have a dream: to help build Botswana’s Intellectual Property culture. A Botswana where entrepreneurs, creatives, institutions and policymakers understand that ideas are assets; that culture has economic value; and that what we create, we must know how to protect, own and commercialise.

My greatest contribution to IP will not simply be what I know about the law. I want to make ordinary entrepreneurs fall in love with Intellectual Property and understand its place in building wealth, businesses and ultimately our economy.

From our national symbols to our culture, creativity, brands and indigenous knowledge, IP is not merely a legal conversation.

It is an economic conversation. It is a development conversation. It is Botswana’s future.

And now, every week, I get another platform to build that culture, one article at a time.

PATENTS: whats patentable?

Having a new idea does not automatically mean you have a patent.

For an invention to qualify for patent protection, it generally needs to be:

1 New: it must not already form part of what is publicly known.

Inventive: it should not be an obvious development to someone skilled in that field.

Industrially applicable: it must be capable of being made or used in industry.

This is why inventors should be careful about publicly disclosing an invention before seeking professional IP advice. Disclosure can affect patentability.

A patent is not simply a certificate for having a clever idea.

It is a legal tool for protecting qualifying innovation.

What is a Patent? | Lesson 005

A patent protects an invention that meets the legal requirements for patentability. It gives the patent owner exclusive rights over the invention for a limited period, generally up to 20 years, subject to applicable requirements and maintenance fees.

A Botswana example:
The Botswana International University of Science and Technology (BIUST) is listed by C**A as the owner of Botswana patent publication/application BW-P-2024-3, titled “An Electrical Switching System for a Building or Installation.” The invention relates to controlling electricity within a building or installation.

This is why patents matter: innovation can become an Intellectual Property asset.
