In Georgia, there’s no longer a legal distinction between a Medical Power of Attorney (POA) and a Healthcare Directive. State law combined them into one document called the Georgia Advance Directive for Health Care.

Before July 2007, you had to complete two separate forms to plan your medical care:
• Durable Power of Attorney for Healthcare – to name someone to make medical decisions for you.
• Living Will – to outline your preferences for life support and end-of-life care.

Since juggling two laws led to confusion and inconsistent requirements, the Georgia General Assembly merged them into today’s Advance Directive. The modern form covers both purposes in clear sections:

→ Part 1: Health Care Agent – appoints someone (and backups) to make decisions if you can’t.
→ Part 2: Treatment Preferences – details your wishes for treatments like ventilators, CPR, and artificial nutrition/hydration.
→ Part 3: Guardianship Nomination – lets you choose who should be your legal guardian if a court decides one is needed.

By law, you must sign an Advance Directive in front of two adult witnesses. Your health care agent, a notary, or anyone who could inherit from you can’t be a witness. A notary seal isn’t required, though many people still choose to include one.
