What happens when your client wants to trademark a name?

It may sound distinctive to the client.

But what if a trademark search reveals dozens of registrations and applications incorporating that same name for identical or related goods and services?

Now you have a very different problem.

The question isn't simply whether someone else owns the exact same mark.

It's whether the name is distinctive enough in that particular field to function as a strong trademark, and what, if anything, your client can add to distinguish its mark from everyone else.

That's where trademark counseling becomes critically important.

Clients don't necessarily understand crowded fields, weak marks or narrow scopes of protection.

They just know the name they want to use (whether it's a first name or a surname).

A trademark attorney needs to understand what the search results actually mean and how to advise the client about the risks of moving forward. In my experience, clients are very slow to rebrand when a name of any kind is involved.

In the Trademarkabilities® Masterclass, we teach attorneys how to analyze these real-world issues and counsel clients about the strength and protectability of their name marks.

Because trademark practice is not about finding an exact match and filing an application.

It's about knowing what to do with what you find.

If you're an attorney who wants to learn how to navigate these issues, get started now. Link in bio.

Why do so many businesses choose descriptive names?

Maybe it's to optimize their SEO.

Maybe they want potential customers to immediately understand what they sell.

Maybe they simply believe that a name that describes their product or service is a good name.

From a trademark perspective, however, there's a big problem.

The more a name describes what the business does, the less distinctive and potentially less registrable the name may be.

And if the name is highly descriptive, it isn't protectable as a trademark at all.

This creates a disconnect between client and trademark attorney and a huge challenge for those new to trademark law.

A client wants a name name that tells customers exactly what the business does and wants to be able to exclude others from using the same or similar terminology. Trademark law likely cannot help that client.

So how does a trademark attorney guide that client?

In the Trademarkabilities® Masterclass, we navigate issues exactly like these. Because trademark practice involves much more than conducting a clearance search and filling out an application form.

It requires understanding how to evaluate a client's proposed mark, manage expectations and recognize when a client's branding strategy may not align with its trademark strategy.

If you're an attorney who wants to learn how to navigate these nuanced issues, get started now. Link in bio.

Many of our clients struggle with providing us with specimens of use to support their trademark applications.

In the Trademarkabilities Masterclass, we spend a lot of time discussing specimens and we review a number of hypos to help attorneys new to trademark law understand how to counsel their clients.

This week, we'll review specimens of use for goods. There are a number of different ways to prove use for goods.

Clients can submit:
🔹 Photographs that show the mark on the actual goods or packaging
🔹 Tags
🔹 Labels
🔹 Instruction Manuals
🔹 Containers
🔹 Displays associated with the actual goods at their point of sale

Getting specimens right the first time, saves everyone heartache and time. If you're looking to elevate your trademark skills, Trademarkabilities can help.

Use in commerce is a concept that new attorneys to trademark law especially struggle with.

Offering goods and services for sale is not the same as using them in commerce. That distinction quietly kills more applications and registrations than attorneys realize.

Use in commerce requires an actual, completed transaction - not just advertising, marketing, or an offer to sell.

Even experienced attorneys sometimes get this wrong and it's fatal to a client's trademark.

In the Trademarkabilities Masterclass, we teach attorneys the critical questions to ask their clients to develop good habits. We review a number of hypos to try to drive these concepts home.

After 21 years of trademark practice, I can tell you this:

Office Actions are NOT random.

The same refusals come up over and over again.
Likelihood of confusion.
Merely descriptive.
Primarily merely a surname.
Failure to function.
Specimen refusals.

Once you've seen enough of them, you start to recognize the patterns. Of course, the facts are always different, but you will start to understand what the examiner is looking for. You will know which arguments you can utilize to be effective and which ones won't help the case. You'll know when to recommend fighting and when to counsel your client toward a different path.

That pattern recognition is what experience gives you.

But here's the thing, you don't have to spend years getting beaten up by Office Actions to develop this pattern recognition skills. You can learn it.

A robust and practical training program can help you recognize the patterns.

The Trademarkabilities Office Action Refusals course walks you through the most common refusals, the strategies that work, and gives you a library of response templates that work. You can adapt these to your own fact situation, so you can show up for your clients with the judgment of someone who's seen it all before.

Even if you haven't. Yet.

Raise your hand if you've ever gotten this call. 🙋‍♀️

"We already checked, the name is available. We just need to hire you to file it."

Every trademark attorney has received a call like this from a prospective client.

And seasoned trademark attorneys know that a search the client conducts is not going to cut it. Clients don't know what they don't know. That's not a criticism - it's just the reality of working in a highly specialized field.

They don't know that "available" isn't binary. That a search requires training and often is not the result of looking up results, but of weighing options and risk against case precedent. That the opinion letter you write after a full clearance search is one of the most important documents in a client's brand-building journey.

Part of our job is educating clients on why the attorney search matters.

The other part is making sure we are trained to do it right.

If you're an attorney looking to sharpen your searching and clearance skills - or build them from the ground up - the Trademarkabilities Searching & Clearance course is the place to start.

Your client doesn't understand trademark law.

But they understand one thing very clearly: the USPTO has said there is a problem with their trademark application.

How you handle that moment matters enormously, not only for your client relationship, but for your reputation, and frankly, for your own confidence as a practitioner.

The attorneys who navigate Office Actions well aren't just better at legal arguments. They're better at managing client expectations, explaining risk, and presenting options so their clients can actually evaluate their options.

Seasoned attorneys will often present:
🔹 One or more options and the associated costs.
🔹 One recommended course of action and the reasons why.
🔹 What happens if we do nothing.

But learning how to do this takes practice. It comes from understanding the most common refusals deeply enough that you're never caught flat-footed, and having a library of responses and strategies ready to deploy.

That's exactly what the Trademarkabilities Overcoming Office Action Refusals course teaches.

Six months down. Six to go.

If you set a goal this year to build real independence in your practice with your own clients, how's that going?

Because let's be honest, if you've been waiting for your dream job, you may have noticed the legal job market is rough right now.

So stop waiting.

If nobody's going to hand you your dream job, build it on your own.

That's the difference between attorneys who talk about going independent and attorneys who actually do it. The ones who do it aren't waiting on the market to improve. They're building something no matter what the market around them is doing.

That's exactly what the Trademarkabilities® Masterclass was built to shortcut. 70+ templates, live Q&A calls, and a community of attorneys who've already earned the independence you're working toward are compressed into one comprehensive training program, instead of you spending years trying to figure it out on your own by trial and error.

If real independence in your practice is part of your plan for the back half of this year, your moment is now: the $250 discount closes at 10pm CT today.

This weekend we celebrated a huge milestone: 250 years of America's independence. 🎆 I hope you enjoyed your holiday weekend.

As I reflect on this country's rich tapestry and my own immigrant and first generation attorney story, I want to continue the celebration.

If you've been thinking about leveling up your trademark practice and becoming more independent, I have a special offer for you.

Trademark law looks straightforward from the outside. Pass the bar. Learn the rules. File the applications. But practitioners who've been in the trademark trenches know the truth: the rules are the easy part. It's the judgment calls - the ones no CLE ever teaches you - that define how good you really are.

That's exactly why I created the Trademarkabilities® Masterclass. It's a unique, comprehensive training program that teaches you how to actually practice trademark law, complete with 70+ templates, live Q&A calls, and a community of attorneys to support your learning. It's designed to compress years of hard-won experience into one program, so you can show up for your clients on day one with the confidence and judgment of a more seasoned trademark attorney. There is no other course like it on the market.

To mark the occasion, I'm offering a $250 discount off enrollment on the Masterclass until 10pm on July 9, 2026, bringing the total investment to just $2,995.

If you've been looking for a sign, this just might be it.

Nobody warns you about your first Office Action.

You filed a trademark application. Solid mark. Good goods and services description. You felt good about it.

Then 4-6 months later, you receive a refusal of registration - an Office Action.

And suddenly you're staring at a 10-page USPTO letter explaining why your client's mark can't be registered, filled with case citations you weren't expecting and a 3-month clock ticking in the corner.

This is the moment a lot of attorneys realize that filing a trademark application and defending them are two very different skills.

Office Actions aren't rare. They're routine. The USPTO issues them regularly and even or substantive refusals like likelihood of confusion, merely descriptive, failure to function, and specimen refusals. And each one requires a different strategy, a different argument, a different approach.

Knowing how to respond and responding well to the issues is what separates attorneys who build thriving trademark practices from those who just phone it in and do a disservice to their trademark clients.

If you've been caught off guard by an Office Action refusal, you're not alone. Receiving an Office Action does NOT make you a bad attorney. There is nothing wrong with your skills.

If you're looking to elevate your Office Action response skills, Trademarkabilities can help. Our Overcoming Office Action Refusals course will teach you everything you need to know to address both administrative and substantive refusals. You will build your confidence in no time.
