Local 710 Breakthru Drivers ‘Strong As Day One’ as Twelfth Week Approaches

Teamsters Local 710 Drivers at Breakthru Beverage in Cicero and Rochelle, Ill. have been on strike for eleven weeks. The unfair labor practice strike began the morning of May 5 when drivers who started their routes for the day were called back in by the Union, leaving the company scrambling.

“These scabs attempting to do our work are giving Breakthru a bad name, and it’s painfully obvious that they can’t do the job the way we can,” said Driver and Bargaining Committeeman Tony Ortiz. “We are eleven weeks deep on this picket line, and this is when they expect us to crack and bet that we’ll turn on each other. Not us, not ever. Won’t happen. We stand together in solidarity with the strongest Local in the country standing right alongside us. This one fight is all our fight, and we won’t back down when our rights are on the line.”

The Teamsters are encouraging our community members to show support by not purchasing any products delivered by Breakthru. Stores, restaurants, and bar owners can call Breakthru’s Cicero Corporate Office at (708) 298-3333 and demand their products be delivered by Union members – some owners have even refused deliveries. This Memorandum is an important update to the Yellow Bankruptcy proceedings. Please review this memo carefully.

YELLOW’S PLAN OF LIQUIDATION GOING INTO EFFECT

As we informed you in a previous update, in late 2025 the Bankruptcy Court approved Yellow’s Plan of liquidation. While Equity Holder MFN Partner’s appeal challenging the Bankruptcy Court’s decision to approve the Plan remains pending, the appeal does not stay the implementation of Yellow’s Plan. On July 1, 2026, Yellow notified the Bankruptcy Court and all interested parties in writing that the effective date for the Plan had occurred.

The Implementation of Yellow’s Plan means all of Yellow’s assets have been transferred to the Liquidating Trustee, who is former Akin Attorney Daniel Golden. The Liquidating Trustee will be responsible for distributing Yellow’s assets to creditors; and will step into the shoes of Yellow for all claim objections, litigation, and appeals. The Liquidating Trustees’ decisions must be approved by a majority of disinterested members on a Board of Managers. The members of the Board of Managers include Golden, the Central States Pension Fund, the New York State Teamsters Pension Fund, Creditor RFT Logistics, and Debtor appointee Matthew Doheny. Major decisions made by the Liquidating Trustee, such as agreeing to settle major claims against the Estate and to settle or withdraw major litigation, must also be approved by the Bankruptcy Court.

We want to be clear that neither Chapter 11 of the Bankruptcy Code nor the Plan approved by the Bankruptcy Court requires the Liquidating Trustee to make any payments to any creditors within 30 days. There are no deadlines by which the Liquidating Trustee must make any payments to any creditors. The Teamsters still need to work out with the Liquidating Trustee certain contract claims that the Teamsters membership filed proofs of claim for. The litigation over whether Yellow owed liability under the WARN Act to the Teamsters membership has not concluded. Any resolution of the contract or WARN Act claims must be approved by the Bankruptcy Court.

Even if the Bankruptcy Court approves a resolution, payments to creditors may still be delayed because other creditors have the right to file an appeal to challenge the Bankruptcy Court’s decision to approve the resolution. For example, currently the Liquidating Trustee’s ability to make payments to creditors is limited because MFN filed an appeal challenging the Bankruptcy Court’s decision to approve Yellow’s settlements with most pension funds. Because the outcome of the appeal affects to whom a substantial portion of Yellow’s estate should be paid, the Liquidating Trustee must wait for the outcome of the appeal before distributing the affected monies to creditors.

O’BRIEN, ZUCKERMAN REELECTED TO SECOND FIVE-YEAR TERM LEADING TEAMSTERS

The International Brotherhood of Teamsters announced today that Sean M. O’Brien and Fred Zuckerman have been reelected to another five-year term as General President and General Secretary-Treasurer, respectively, renewing a mandate for powerful, militant leadership on behalf of 1.3 million rank-and-file Teamsters across North America.

The O’Brien-Zuckerman Teamsters United slate was elected by white ballot at the union’s 31st International Convention in Las Vegas following a secret ballot vote of 1,572 delegates. All voting delegates were democratically elected to the convention by rank-and-file members from more than 330 local unions across the United States, Canada, and Puerto Rico. No opposition candidates received enough votes to meet the Teamsters’ constitutionally required threshold to challenge the O’Brien-Zuckerman team.

“This victory belongs to rank-and-file Teamsters. When we were sworn into office four years ago, our leadership team committed to building a bigger, faster, stronger union, and that’s exactly what we’ve done. We’ve organized more than 100,000 new members, won historic agreements including a record contract for 340,000 members at UPS, and put rank-and-file members back in the driver’s seat. The Teamsters is now the most aggressive, effective, and respected labor union on Earth,” O’Brien said. “Over the next five years, we have a lot of work ahead of us. The Teamsters face big fights at UPS and Amazon, and we are prepared to tackle those head on with the militancy and organization that has defined our administration. We will keep growing and never stop working for the members.”

“The Teamsters are stronger, more secure, and more prepared to take on greedy employers than at any point in our 123-year history. We have more than $1 billion in total assets, and our Strike and Defense Fund stands at approximately $365 million, providing the ammunition to take on the boss and protect our members,” Zuckerman said. “The Teamsters have accomplished so much to expand our ranks, exert real political influence, and safeguard our members in an ever-evolving economy. But we’re just getting started. The future is bright and the state of the union is strong in the Teamsters.”

O’Brien is a fourth-generation Teamster from Local 25 in Charlestown, Mass. Zuckerman joined the Teamsters more than four decades ago as a rank-and-file member in Houston and later went on to lead Local 89 in Louisville, Ky. Together, they bring an aggressive grassroots approach to taking on employers and prioritizing member involvement in the union.

Over the next five years, O’Brien and Zuckerman have pledged to continue the fight at UPS and Amazon, strengthen Teamsters density in core industries, defend and improve contracts across every division of the union, and build even bigger bipartisan coalitions to pass the Faster Labor Contracts Act and other legislation to benefit working people.
The O’Brien-Zuckerman Teamsters United slate will take the oath of office in March 2027.
