The Members' petition seeks to amend the Bylaws pursuant to Article 13.01. The Association is conducting the vote in advance of the September 14 Special Meeting, as contemplated by Section 3.05. The requirements of both provisions therefore apply.
1. What is required
Article 13.01 states:
“Notice of any proposed amendments to the Bylaws shall be set forth IN THE NOTICE of Meeting”
Section 3.05 requires notice of the proposed action at least 20 days before voting concludes. It also provides that the number of votes cast must equal the 10% quorum required at a meeting of Members.
2. What was done
The September 14 Notice does not set forth the proposed Bylaw amendments. It instead directs Members to Vantaca for additional information - not available 20 days prior to the vote.
Voting is taking place September 7–14, before the September 14 Special Meeting, where the only stated purpose is to announce the results.
The Association has also stated that more than 50% of the entire membership must vote affirmatively, rather than applying the 10% quorum requirement in Section 3.05.
3. Why the notice is defective
The proposed amendments were not set forth in the Notice as expressly required by Article 13.01.
Because the vote is being conducted in advance of the meeting under Section 3.05, the requirements of that section—including 20 days' notice and the 10% quorum requirement—also apply.
THE REQUIRED NOTICE AND VOTING REQUIREMENTS HAVE NOT BEEN MET.
4. What must be done
The petition vote must be postponed. A new Notice must set forth the proposed amendments and provide the required 20 days' notice, with the 10% quorum requirement applied before the vote proceeds.

🔥 HOA IS CHEATING AGAIN 🔥
The HOA has given homeowners 24 hours to submit questions on the petition signed by >40% of the community. Presumably because they simply don't want to hear or answer our questions. Jeff Hackworth - we deserve real answers!
1) How does the Board believe it is ethically defensible for a three‑person Board to amend the bylaws with a simple majority of 3 votes, yet require a super‑majority of more than 703 votes of the entire community to reverse or correct those same amendments?
2) Given that the voting structure the Board plans to adopt grants the Board greater flexibility and power to change the bylaws than the community has to reverse those changes, did every Board member who voted to proceed in this manner properly disclose their inherent conflict of interest and abstain from the vote to proceed in this fashion?
3) In the Board’s comments, they claim member voting is “burdensome, time‑consuming, expensive, and unnecessary.” Why does the Board believe homeowner participation is “unnecessary”?
4) The proposed bylaw changes directly overturn bylaws changes implemented by the Board without community consent or input in November 2025. Why were those bylaw changes implemented in the first place?
5) Why has the Board elected to hold an expensive virtual meeting that mutes participation instead of holding a public meeting where discussion is permitted?
6) Why has the Board sat on this petition for over a year, and now feels it is so urgent to deal with that they must violate both notice and participation requirements?
7) Why has the Board not released any notice to the community, minutes, executive session summaries, voting records, community input, or other non‑attorney‑client‑privileged records pertaining to the changes they made to the bylaws in November 2025, as required by Texas Property Code §209 and the Court Order issued on July 8, 2026?
😎 The Board’s comments state: “The Board, in consultation with the Association’s attorneys, has the following comments on the proposed amendments.”
Unless publicly corrected, it is reasonable for homeowners to conclude that the comments and the voting process represent the professional legal opinions of attorneys Luke Tollett and Sipra Boyd (and RMWBH). Do you wish to correct that perception?
9) The forum announcement states: “The purpose of this forum is to provide members with an opportunity to learn more about the proposed bylaw amendments and ask questions prior to the voting period.” Will all questions be answered as asked? If not, how will the Board claim members were provided an opportunity to ask questions?
10) The legally binding petition states that members must have an opportunity to meaningfully participate in a meeting, including arguing in favor of the petition.
No meeting has been provided for members to present any argument for the petition; in fact, the Board has precluded any such opportunity.
a. How does the Board intend to fulfill that obligation?
b. Does the Board believe it has the authority to modify the petition’s stated purpose so that no meeting is required?
c. If the Board intends to classify this as “a meeting,” do they consider it a “special board meeting” under Property Code §209.0051 or a meeting of the members, as required?
d. Why does the Board feel it is necessary to alter the petition’s required meeting format?
11) Our bylaws, Section 3.04 (Notice of Meetings), require written or printed notice stating the place, day, and hour of any meeting of Members, delivered not less than ten (10) days before the meeting. How does the Board plan to meet this notice requirement?
12) Our bylaws, Section 13.01 (Amendments to Bylaws), require that amendments be voted on by a majority of Members present at a Special Meeting of the Members called for that purpose. How does the Board plan to establish attendance at the required meeting, and therefore determine what constitutes a majority of the Members present?

Even when the air temperature feels manageable, sidewalks and pavement can become dangerously hot under the Texas sun.
Before heading out for a walk, check the pavement with the back of your hand. If it’s too hot for your hand, it’s too hot for your pet’s paws.
Consider walks during the cooler morning or evening hours, and stick to grassy or shaded areas when possible.
