Hurt a specific way on a specific day? That’s likely an industrial injury. Symptoms that built up over months or years, like carpal tunnel? That’s likely an industrial disease.
Washington’s L&I system treats these two claim types differently: different deadlines, different proof requirements. Filing under the wrong one can cost you benefits or time.

L&I. You’ve probably seen the letters. Do you know what they stand for?

L&I is Washington’s Department of Labor and Industries, the state agency that runs the workers’ comp system, not a law firm and not on your side by default.
Our free guide breaks down how L&I actually works: how claims move through the system, what counts toward your benefits, and where injured workers most often lose out.

Is your L&I claim stuck and you don't know why?

We're hosting a free, live Claim Clinic on Thursday, September 24 at 6:00 PM. It's a Q&A with a Washington workers' comp attorney, answering real questions from real injured workers.

Delayed treatment. Benefits that stop without explanation. An IME you didn't ask for. If any of that sounds familiar, bring your question.

Register and submit your question here, and we'll answer as many as we can live: https://bit.ly/3Tk2SMP

Tapping Interested on the event will remind you to watch. Registering is what gets your question in front of the attorney, plus the recording afterward.

Is workers' comp the same thing as L&I? Yes, and that one question brings a lot of injured Washington workers to this page.

Here's what most people miss: once L&I makes a decision on a claim, you have 60 days to protest it (back to the same claim manager) or appeal it (to an independent board). Miss that window, and the decision usually stands.

If someone other than your employer caused your injury, a separate third-party claim can run alongside your L&I claim, not instead of it.

Hurt at work in Washington? The filing deadline depends on what kind of claim you have, and the two are not the same.

An industrial injury (a fall, a machinery accident) has to be filed within 1 year. An occupational disease (something that develops from repeated exposure or job conditions, like carpal tunnel or a lung condition) gets 2 years from written medical notice.

Once L&I classifies a claim one way, it generally cannot be switched to the other category later, even with new medical evidence.

L&I manages about 95,000 workers' comp claims a year in Washington, and one injury tops the list more than any other.

Open wounds of the fingers and fingernails are the single most common accepted L&I claim in the state, and freight workers alone filed about half of all accepted open wound claims in 2022.

A common injury doesn't mean an easy claim. L&I still reviews every case on its own facts, and even the most typical injuries get denied or undervalued.

Think your workplace injury claim goes straight to L&I? For 1 in 3 Washington workers, it doesn't.

Employees at self-insured employers have their claim reviewed by a private claims administrator instead of L&I, and that administrator has a financial stake in the outcome.

A denied claim, a low PPD rating, or a disputed IME result isn't necessarily the final word.

World of Workers: Do You Need an L&I Lawyer?

Most workers don’t think they need a lawyer for their L&I claim — until something goes wrong. A few signs it’s time to get help:

- Your claim was denied
- Benefits stopped without explanation
- You’re told you’re “medically fixed” but still in pain
- You got a settlement offer and don’t know if it’s fair

Most injured workers don't know Washington's L&I will reimburse mileage to medical appointments, or that vocational rehab is available if you can't return to your old job. Both benefits go unused because L&I doesn't advertise them well.

Our latest guide breaks down who qualifies, how to file the paperwork, and the deadlines that trip people up.
