5 things I’m genuinely glad my friends do — as an immigration lawyer 👉🏾
1. They get informed about their options
Most people come to me thinking there’s exactly one visa for their situation, or none at all. In reality, Austria has multiple residence and settlement categories, and which ones are even available depends on nationality, purpose of stay, and family situation. Finding out what actually exists — before deciding anything — is step one.
2. They carefully assess which path is right for them
Two people with similar goals can need completely different permits. The “best” option on paper isn’t automatically the best fit — it depends on income requirements, quota availability, processing times, and what happens if plans change later. Rushing this step is where a lot of avoidable problems start.
3. They plan their application diligently
Certified translations, apostilles, proof of accommodation, health insurance, financial means — immigration files live and die on documentation. Assembling everything properly, in the right form, before submission saves months later.
4. They submit on time.
This matters most for students and workers, where the permit is often tied to a specific start date — a semester beginning, a job start date. Submitting late doesn’t just risk a delay; it can mean missing the window entirely.
5. They don’t overstay their visa or visa-free time.
This is the one I can’t stress enough: filing a residence permit application does not give you a right to remain beyond the validity of your visa, or beyond the 90-days-in-180-days visa-free period. Overstaying can lead to the pending application being cancelled — and to fines or even entry bans, regardless of how strong the underlying case was.
Which German level do you actually need for your Austrian immigration journey? It depends entirely on which stage you’re at — and that’s the part almost nobody explains clearly.
Here’s the real ladder:
🔹 A1 — required for most initial residence permits
🔹 A2 — needed at your second renewal, to stay through year 3
🔹 B1 Integration — permanent residence, after 5 years (Modul 2 of the Integration Agreement — not just any B1 certificate)
🔹 B2 — citizenship on the accelerated 6-year track (current law)
🔹 B1 Integration — citizenship on the standard 10-year track (current law)
⚠️ A reform is currently being negotiated by the Austrian government that could raise these: the 6-year track to C1, and the 10-year track to B2. Nothing is finalized yet — but if you’re close to qualifying under today’s rules, the timing of your application can matter.
One thing that catches people out at every single stage: only certificates from some accredited institutions such as ÖIF, ÖSD, telc, or Goethe-Institut are accepted by Austrian authorities. Private language schools and online platforms — even reputable ones — won’t count, with narrow exceptions Every case depends on your specific permit type and history.
