๐Ÿก Buying an Investment Property with an Existing Tenant?

Found a property you love, but someone is already renting it?

Before you sign the Contract of Sale, here are a few things worth checking! ๐Ÿ‘‡

๐Ÿ”‘ The existing lease โ€” Is there a fixed-term lease or a periodic tenancy? Understand the current rental arrangements.

๐Ÿ“„ The Contract of Sale โ€” Check what it says about the existing tenancy and the arrangements that will apply after settlement.

๐Ÿ  Your plans for the property โ€” Planning to move in yourself or renovate? Don't assume you can ask the tenant to leave immediately. The tenancy agreement and Victorian rental laws may affect your options.

๐Ÿ’ฌ Get advice early โ€” Have the contract and relevant tenancy details reviewed before committing, especially if you need the property to be vacant by a particular date.

Buying an investment property involves more than just the purchase price. Understanding the existing tenancy can help you make a more informed decision. ๐Ÿ’š

๐Ÿก Buying a property? Remember to check your deposit deadline!

Itโ€™s exciting when your offer is accepted โ€” but donโ€™t let the excitement make you overlook an important step.

Before paying your property deposit, remember to:

๐Ÿ”น Check the amount and due date in your Contract of Sale.

๐Ÿ”น Confirm the correct deposit holder and payment instructions.

๐Ÿ”น Keep your payment confirmation.

๐Ÿ”น Contact your conveyancer early if youโ€™re unsure about anything.

โš ๏ธ Missing the deposit deadline may have serious consequences under your contract, so donโ€™t leave it until the last minute.

Buying a home involves many important dates. Having someone help you understand them can make the process feel much less overwhelming. ๐Ÿ’š

At Prox Conveyancing, I help buyers and sellers navigate Victorian property transactions with clear communication and practical guidance.

๐Ÿ  The seller accepted your offer โ€” can they still sell the property to someone else?

Imagine thisโ€ฆ

You make an offer on a property.
The agent tells you the seller has accepted it. ๐ŸŽ‰

You think, โ€œGreat! The property is mine!โ€

Then you find out another buyer is interested. ๐Ÿ˜Ÿ

So, can the seller still sell it to someone else?

It depends on where things are up to with the Contract of Sale.

๐Ÿ”น An accepted offer is not necessarily the same as a signed and binding Contract of Sale.

๐Ÿ”น Before a binding contract is entered into, the situation can be different.

๐Ÿ”น Once a binding Contract of Sale exists, the seller has contractual obligations to the buyer.

๐Ÿ‘‰ The key takeaway: Donโ€™t assume that an accepted offer means the property is legally secured.

If you're buying a property, make sure you understand what stage the transaction has reached before relying on a verbal acceptance of your offer.

๐Ÿก Buying property can move quickly โ€” knowing where you stand matters.

๐Ÿ  What if you find a problem at your final inspection?

Youโ€™re about to settle on your new home. You attend the final inspectionโ€ฆ and notice something isnโ€™t quite right. ๐Ÿ˜Ÿ

For example:

๐Ÿ”น Thereโ€™s new damage to the property
๐Ÿ”น Something that was included in the sale is missing
๐Ÿ”น The property isnโ€™t in the condition you expected
๐Ÿ”น Rubbish or belongings have been left behind
๐Ÿ”น Agreed repairs havenโ€™t been completed

So, what should you do?

๐Ÿ‘‰ Donโ€™t panic โ€” but donโ€™t ignore it either.

The final inspection is an important opportunity to check the property before settlement.

If you find a problem, let your conveyancer know as soon as possible. Depending on the issue and the terms of the Contract of Sale, there may be steps that can be taken before settlement.

Every situation is different, so itโ€™s important to look at the contract and the circumstances.

๐Ÿ’ก A final inspection isnโ€™t just about checking whether the house looks nice. Itโ€™s one of the last important checks before settlement.

What Happens After Signing a Property Contract in Victoria? Property Settlement Guide - Prox Conveyancing What Happens After You Sign a Contract in Victoria? 17/09/2026

๐Ÿ  Can a buyer change their mind after signing a Contract of Sale?

Youโ€™ve found the property you love, signed the Contract of Saleโ€ฆ and then suddenly you start having second thoughts. ๐Ÿ˜Ÿ

So, can you simply change your mind?

Not necessarily.

A few things can make a difference:

๐Ÿ”น Is the contract already binding?
Once a Contract of Sale becomes binding, simply changing your mind does not necessarily mean you can walk away without consequences.

๐Ÿ”น Does cooling-off apply?
In some circumstances, a buyer may have a cooling-off right, but there are exceptions and specific rules.

๐Ÿ”น What does your contract say?
Special conditions and the circumstances of the purchase can affect your rights and obligations.

๐Ÿ‘‰ The key takeaway: Donโ€™t assume that you can simply cancel a property purchase because you have changed your mind.

Understanding what happens after signing can help you know what to expect.
