⚖ Most people have heard the word 'probate' without knowing what it actually costs their family — or whether it can be avoided.

Probate is the formal court process of validating a Will and authorizing an executor to administer an estate. It is required when:

→ Financial institutions require it before releasing assets held solely in the deceased's name
→ The estate includes real property in Alberta
→ There are disputes or ambiguities between beneficiaries

What does it cost?
In Alberta, probate fees are based on the gross value of the estate. On a $600,000 estate, fees can exceed $3,000 — plus legal costs and time.

Can it be avoided?
Sometimes. Proper beneficiary designations on registered accounts, joint ownership with right of survivorship, and well-structured trusts can reduce or eliminate probate.

The right estate plan minimizes what your family has to manage. Legal EDGE builds plans that use every available tool.

⚖ Most homebuyers celebrate when their offer is accepted. And they should. But the work that actually protects you begins right after — during the condition period.

In Alberta, purchase agreements typically include conditions that give you the right to withdraw if specific requirements aren't satisfied:

🔍 Financing condition — your lender formally approves the mortgage for this specific property. Not pre-approved. Formally approved.

🔍 Home inspection condition — a licensed inspector reviews the property. Their findings can be grounds to renegotiate or withdraw entirely.

🔍 Condo document review — for strata properties, you have the legal right to review all financial statements, bylaws, reserve fund reports, and AGM minutes before committing.

Once conditions are waived, the deal is binding. Missing a deadline — even by one day — can cost you your deposit.

Legal EDGE reviews your conditions before you waive them.

Spousal support in Alberta is neither automatic nor guaranteed. Whether you receive it — or pay it — depends on four factors courts apply to your specific situation.

Factor 1: The length of the relationship. Longer relationships generally result in longer — sometimes indefinite — support obligations.

Factor 2: The roles each spouse played. A spouse who left a career to raise children or support the other's professional growth is treated differently than one who maintained independent employment throughout.

Factor 3: The income gap at separation. The greater the difference, the more likely support becomes — and the longer it may last.

Factor 4: Each spouse's realistic ability to become financially self-sufficient. Courts consider age, education, and current employment market access.

Spousal support decisions made without legal guidance can lock you into arrangements that don't reflect your actual situation — for years.

⚖️ Your Will may not control all of your assets when you die.

This is an estate-planning issue that can easily be overlooked.

Assets such as your RRSP, TFSA, pension benefits and life insurance may have beneficiary designations. Depending on the type of asset and how the designation was made, those assets may pass directly to the designated beneficiary rather than through your estate under your Will.

That means:

→ Your Will may leave your estate to your children, while an RRSP, TFSA or insurance policy may have a different beneficiary designation.

→ After a marriage, separation or divorce, outdated beneficiary designations should be reviewed to make sure they still reflect your intentions.

→ If a beneficiary dies before you and you have not named an alternate beneficiary, the proceeds may become payable to your estate, depending on the type of account or policy and the applicable designation.

A Will is only one part of an estate plan.

Whenever there is a major life change — marriage, separation, divorce, the birth of a child or the death of a beneficiary — it is a good time to review both your Will and your beneficiary designations.

Legal EDGE can help you review your estate plan so that your Will and beneficiary designations work together and reflect your intentions.

⚖ Buying property with a business partner, family member, or friend is more common in Calgary than most people realize.

And the legal structure you choose at purchase determines everything that happens after — especially when circumstances change.

There are two legally distinct ways to co-own property in Alberta:

Joint Tenancy — if one owner dies, their share automatically passes to the surviving owner. No Will required. No probate involved.

Tenants in Common — each owner holds a defined share. When one owner dies, their share passes according to their Will — not automatically to the co-owner.

If you're buying with someone other than a spouse and haven't discussed which structure applies to you, that conversation needs to happen before you sign.

Legal EDGE ensures co-ownership is structured correctly from day one — so decisions made years later don't create unexpected legal and tax problems.

When Alberta courts determine custody or parenting arrangements, only one standard matters: the best interests of the child.

Here's what that actually includes — and what it doesn't:

1. Each parent's demonstrated ability to meet the child's daily physical and emotional needs — not just stated willingness.

2. The child's existing routines, school, friendships, and community — disruption is weighed seriously.

3. Each parent's willingness to support the child's relationship with the other parent — this matters more than most people expect.

4. History of family violence, substance issues, or instability — courts look at documented history, not accusations made after separation.

5. The child's own preferences — considered based on age and maturity.

What the court does NOT decide based on: who moved out first, who filed first, or who has a larger home.

⚖ Most people think estate planning means writing a Will. That's one piece — and not always the most urgent one.

A complete Alberta estate plan includes four documents:

Your Will — directs what happens to your assets after death. Names guardians for minor children. Appoints an executor.

An Enduring Power of Attorney — gives a trusted person authority over your finances if you become incapacitated. Cannot be created after you lose mental capacity.

A Personal Directive — directs healthcare and personal decisions if you cannot make them yourself. Separate from a Power of Attorney.

Beneficiary designations — on your RRSPs, TFSAs, and life insurance. These bypass your Will entirely. If outdated, assets go to the wrong person regardless of what your Will says.

Legal EDGE builds complete estate plans tailored to your actual situation — not a template.

⚖ Most sellers think legal involvement begins at closing. It should begin the moment you decide to list.

Here's what Legal EDGE handles before your home closes:

The purchase agreement — your obligations don't end at signing. They continue through conditions, timelines, and what happens if a buyer walks away after conditions are waived.

Title status — is it clean? Outstanding liens or judgments can delay or cancel your sale without warning.

Disclosure requirements — in Alberta, sellers have specific legal obligations. Missing them exposes you to liability long after closing.

Transfer of funds — Legal EDGE secures the proceeds through a regulated trust account before they reach you.

Your legal protection ends when the transaction does — but only if it was documented correctly from the start.
