A restrictive covenant may be registered against a property, but who actually has the right to enforce it?
Depending on how the document is written, enforcement rights may belong to a condominium corporation, an HOA, individual landowners or another party. The agreement may also set out a specific process that has to be followed.
Before taking enforcement action, start with the document itself.

When can a drug dosing regimen be patented in Canada? The Supreme Court of Canada has provided new guidance.
In Pharmascience Inc. v. Janssen Inc., the Court upheld a patent covering specific dosing regimens for a schizophrenia drug, finding that the claimed invention did not require physicians to exercise professional skill and judgment in carrying it out.
The decision confirms that methods of medical treatment remain unpatentable in Canada, while also making clear that not every patent involving how medicine is administered will fall into that category.
As Richard Stobbe explains, the SCC identified three considerations that can help courts determine where that line should be drawn.

Can an AI tool be an author under Canadian copyright law?
That question is now before the Federal Court in a case involving “Suryast,” an image registered with both a human creator and the RAGHAV Artificial Intelligence Painting App listed as co-authors.
CIPPIC is challenging the registration, arguing that Canada’s Copyright Act protects human authorship. The registrant takes a different position, arguing that the legislation does not expressly require an author to be an individual and that both he and the AI tool contributed to the creation of the work.
As Richard Stobbe explains, the case could provide important guidance on where Canadian copyright law draws the line between human authorship and generative AI.

September brought a mix of significant legal developments and practical considerations for organizations across industries.
Alberta’s incoming Care-First automobile insurance regime was a major focus, with changes set to reshape how motor vehicle injury claims are handled beginning in 2027. We also explored procedural fairness and disclosure in workplace investigations, including how employers can balance transparency with focused, proportionate disclosure.
Technology and privacy continue to raise new questions as well. A case before the Federal Court could help clarify the role of human authorship when AI contributes to creative work, while a recent Alberta decision recognizing the tort of intrusion upon seclusion could have broader implications for organizations handling sensitive personal information.
Catch up on these developments and more in the September edition of FieldNotes.
September 2026 Welcome to the latest edition of FieldNotes, a monthly roundup of our recent articles, webinars, and events. As you may be aware, we release publications covering various legal topics, from labour + employment to construction to artificial intelligence and everything in between.

In BD v Germain, the Alberta Court of King’s Bench recognized the tort of intrusion upon seclusion, allowing individuals to pursue a claim where someone intentionally or recklessly invades their private affairs in a way that would be considered highly offensive.
The decision fills a gap in Alberta’s common law and could have broader implications for employers and organizations that collect, store or access sensitive personal information.
As Hasti Pourriahi explains, organizations should remain mindful of the safeguards they have in place to prevent unauthorized access or misuse of personal information.
