Proving hard-to-prove LTD claims for "invisible disabilities."

08/04/2026

Living with a disability is hard enough. The legal process shouldn't make it harder.

When you're dealing with chronic illness, chronic pain, PTSD, Long COVID, ME/CFS, anxiety, depression, or another invisible disability, even simple tasks can feel overwhelming.

Unfortunately, pursuing a long-term disability claim often adds more stress through paperwork, deadlines, interviews, and uncertainty.

At Mulqueen Disability Law, we've intentionally built our practice differently.

Our trauma-informed approach recognizes that legal representation should reduce stress—not create more of it. We strive to communicate clearly, respect your limits, and advocate for you with compassion while fighting for the benefits you deserve.

If you've ever felt overwhelmed by the disability claims process, this article is for you.

Think your Chronic Fatigue Syndrome (ME/CFS) diagnosis should be enough to qualify for long-term disability benefits? Unfortunately, it often isn't.

People living with Chronic Fatigue Syndrome (ME/CFS) frequently face unfair scrutiny from insurance companies because their symptoms are largely "invisible" and difficult to measure with traditional medical testing. That doesn't mean your claim should be denied.

In my latest blog, I explain:
✔️ Why chronic fatigue claims are so often denied
✔️ The mistakes that can weaken your claim
✔️ What evidence insurers really look for
✔️ How to strengthen your case and protect your right to benefits

If your LTD claim has been denied—or you're worried it might be—understanding the claims process can make all the difference.

Termination does not always end a person's right to long-term disability benefits.

A recent Ontario court decision highlights an important principle: if disability arose while coverage was still in force, an LTD claim may still be available.

Our latest article examines the legal issues, the role of medical evidence, and what employees should know if they were terminated while experiencing significant health challenges.

AI is changing how long-term disability claims are reviewed — and many claimants don’t even realize it.

Insurance companies are increasingly using AI to identify patterns, flag inconsistencies, and assess claims behind the scenes.

So what can you do to protect yourself?

In Part 3 of our AI and disability claims series, we explain:
✔️ Why consistency across your claim matters
✔️ How “good days” can be misunderstood
✔️ Why medical records may not tell the full story
✔️ How small details can trigger increased scrutiny
✔️ What practical steps you can take to strengthen your claim

Your claim is not just paperwork.
It’s your lived experience — and it deserves to be properly understood.

Insurance companies are increasingly using AI in long-term disability claims — but most people don’t realize how much it may influence the process.

AI can help insurers process claims faster by organizing records and identifying patterns. But it can also flag “inconsistencies,” increase scrutiny, and miss the human reality behind chronic pain, mental health conditions, fatigue, and fluctuating symptoms.

Your claim is more than data points.

As AI becomes more integrated into the claims process, understanding how your file may be assessed is more important than ever.

More people are using AI to help manage their LTD claims.

And it can help—with organization, communication, and understanding the process.

But there’s a line.

AI provides general information.
It doesn’t understand your policy, your medical evidence, or how insurers handle claims in practice.

That gap can lead to confusion, mistakes, or unnecessary stress.

Used properly, AI can support your claim.
It shouldn’t guide it.

Mental Health Week is a reminder that not all disabilities are visible—and not all struggles are easy to explain.

For many people navigating mental health conditions, the challenge isn’t just the symptoms—it’s being understood, supported, and believed.

Whether you’re seeking treatment, taking time off work, or navigating a disability claim, your experience matters.

Support should never come with doubt.

Approved for CPP disability and your LTD payments dropped?

That’s expected—but the calculation still has to be correct.

We’re seeing more cases where insurers:
• use the wrong CPP-D amount
• include increases they shouldn’t
• deduct dependent benefits improperly

These errors are not always obvious—but over time, they can mean you’re being underpaid.

If something doesn’t look right, it’s worth reviewing.

An Insurance Medical Examination (IME) is not treatment—it’s part of your LTD claim.

These assessments are arranged by the insurer and focused on one thing: your work capacity.

What you say, do, and demonstrate during the IME can directly impact your benefits.

Preparation matters.
So does understanding your rights.
