As hunters across Ontario head out for the fall season, the use of ATVs becomes essential for navigating rough terrain and transporting gear. However, changing weather, heavy loads, and concealed trail hazards significantly raise the risk of severe off-road accidents.
When an ATV crash occurs, navigating the aftermath can be complex. Serious injuries often involve overlapping legal and insurance issues, including statutory accident benefits, property liability, and claims against negligent riders.
Understanding your rights and how Ontario's insurance regulations apply is crucial if you or a loved one is injured off the trail this season.

The Ontario Court of Appeal recently affirmed that proceeding with a personal injury trial was not unfair to a defendant, even after defence counsel became ill during the proceedings. The ruling underscores the high standard courts apply when balancing procedural fairness against the timely resolution of personal injury claims for injured plaintiffs.
For accident victims navigating the civil justice system, procedural delays can significantly impact financial recovery and access to necessary care. This decision serves as an important reminder of the court's commitment to avoiding unnecessary trial adjournments while maintaining overall fairness for all parties involved.

When a commercial landlord defaults on their mortgage, commercial tenants face significant uncertainty regarding their tenancy and lease enforceability. Unlike residential tenancies, commercial leases in Ontario do not automatically bind a lender who takes possession under a power of sale or foreclosure unless the lender consented to the lease or a Subordination, Non-Disturbance, and Attornment (SNDA) agreement is in place. Without an SNDA, a lender enforcing its security may choose not to recognize the lease, leaving tenants vulnerable to eviction or forced renegotiation.

A recent Ontario Superior Court decision (Nardi v. Sorin Group) highlights a crucial rule for personal injury claims: missing a class action opt-out deadline can permanently bar your right to file an individual lawsuit.
Even though the plaintiff developed a severe, delayed heart infection years after surgery and acted in good faith, the court refused a late opt-out because a class settlement had already been negotiated.

Airbags are meant to protect passengers during a collision, but when these critical safety systems fail to deploy or malfunction, they can cause severe and life-altering injuries.
In vehicle accident claims, determining liability goes beyond the actions of drivers on the road. When a defective safety component contributes to or worsens an injury, motor vehicle manufacturers or parts suppliers may also be held accountable under product liability law. Identifying all responsible parties is essential to securing full compensation for medical treatment, lost income, and long-term care.

In Crowley v. Security National Insurance Company, 2026 CanLII 80181 (ON LAT), Ontario’s Licence Appeal Tribunal ruled that an off-road ATV crash on private land constituted an "accident" under s. 3(1) of the Statutory Accident Benefits Schedule. Despite the applicant lacking a motor vehicle liability policy, the LAT confirmed entitlement to accident benefits for a traumatic brain injury, clarifying how vehicle classification and property characteristics impact coverage boundaries for off-road incidents. https://ow.ly/EmYr50Zzs4B
