MISCARRIAGE LEAVE

Following a miscarriage:
✔ Every worker, irrespective of gender, is entitled to 7 working days of miscarriage leave
✔ Without loss of wages
✔ Leave must be taken immediately following the miscarriage
The entitlement applies whether the miscarriage occurs in Malta or abroad.

PARENTAL BEREAVEMENT LEAVE
🕊️ A new employment protection introduced in 2026.

From 1 January 2026, workers are entitled to:
7 working days of Special Parental Bereavement Leave
This applies following the death of a child under 18 and is granted without loss of wages.

✔ Rights for single and two-parent households

Where both adoptive parents are employed, they may agree in writing on how the leave will be divided.

✔ 100 hours of paid leave per couple

✔ Available for up to 3 IVF cycles
✔ Applicable whether treatment takes place in Malta or abroad

The entitlement applies to both men and women.

PARENTAL LEAVE

👨‍👩‍👧 Parental leave goes beyond maternity and paternity leave.

Each parent may be entitled to:
✔ 4 months of parental leave per child
✔ Available until the child turns 8
✔ Applicable to birth, adoption and fostering
✔ First 2 months paid according to the applicable benefit rules
✔ Remaining 2 months unpaid

Eligibility requirements apply, including generally having at least 12 months' employment with the employer.

MATERNITY BENEFITS EXPLAINED

Maternity Leave Benefit applies to the final four weeks of the 18-week maternity leave period.

Separately, Maternity Benefit may apply to qualifying mothers who do not make use of employer-paid maternity leave, as well as qualifying self-employed mothers.
