A Florida woman who fatally shot a 62 year old retired Army staff sergeant during a confrontation over a Walmart parking space will not face criminal charges after prosecutors determined that the shooting was legally justified under the state’s Stand Your Ground law.

The incident happened on June 30, 2026, shortly before 12:30 p.m., at a Walmart parking lot on West McNab Road in North Lauderdale. Melissa Payne was in a Chevrolet Malibu with her niece and the niece’s infant, while Bart DiGuglielmo, 62, was driving a Kia.

According to investigators, both drivers attempted to take the same parking space, leading to a confrontation. Both eventually got out of their vehicles.

Prosecutors said cellphone footage and video from a nearby Tesla captured the encounter. Authorities said DiGuglielmo approached Payne while holding a key and gesturing toward her vehicle. Witnesses reported that he threatened to damage her car.

Payne told deputies that she warned him to stop and backed away before firing a single shot that struck DiGuglielmo in the abdomen. He was taken to Broward Health Medical Center, where he later died.

Payne remained at the scene and placed the firearm on the roof of her vehicle. Deputies detained her and later released her after she claimed self defense.

On September 3, 2026, the Broward State Attorney’s Office announced that Payne would not be criminally charged.

Assistant State Attorney Stephen Zaccor said Florida’s Stand Your Ground law does not require a person to retreat when they reasonably believe deadly force is necessary to prevent death or great bodily harm. Prosecutors concluded that they could not disprove Payne’s self defense claim by the required clear and convincing evidence standard.

However, prosecutors also acknowledged that the available video did not establish that Payne was necessarily in the right. Instead, they determined that the evidence was insufficient to overcome the legal standard required to deny her immunity.
