Before deciding how big your deck should be, think about what you want to do there.

A table needs space around it when the chairs are pulled out. A sunny corner might suit morning coffee, while a comfortable spot to sit may need shelter from the afternoon sun or wind. The route back to the kitchen matters too.

The good news is that finding unconsented work doesn’t mean you have to panic — but it is much easier to look at while nobody’s waiting on you.

It often comes into focus when a property is being prepared for sale. That’s when what’s physically there may be compared with the property records, questions can be raised by buyers or their advisers, and insurance may need to be considered too.

So the useful move is to look at it early — and that’s work we can help with.

We’ll assess what’s actually there, review the available records and help determine the likely pathway. Where a Certificate of Acceptance is appropriate, that may include preparing drawings and supporting information for the application and working through council questions.

Well before the property is listed, rather than during a sale.

A Code Compliance Certificate and a Certificate of Acceptance are not the same thing.

A CCC relates to work carried out under a building consent and confirms the building consent authority is satisfied, on reasonable grounds, that the completed work complies with the consent.

A Certificate of Acceptance is different. It can be used in certain circumstances for work that was carried out without the building consent that should have been obtained. For this type of application, the work must have been carried out on or after 1 July 1992.

The important limitation is that council can only certify the work to the extent it can establish compliance. That may involve inspections as well as plans, reports, photographs, producer statements or other supporting evidence.

So a CoA isn’t simply a retrospective CCC.

If you have building work that was never consented or signed off, it’s worth understanding what you actually have before deciding what to do next.

The work you’re looking at here is restricted building work.

The rafters, the bracing, the wrap sitting behind the cladding — the structure holding the house up and the layer helping keep the weather out.

Work like this has to be carried out or supervised by an appropriately Licensed Building Practitioner, and each trade LBP provides a Record of Work for the restricted building work they carried out or supervised. Those records go to the owner and council and form part of the code compliance certificate process.

The builder delivers the construction. Our role on this side of the project is everything around it — coordinated drawings and supporting information for the consent, lodging it and working through council’s questions, then handing over an organised set of approved documents.

We’ll also talk you through the inspection and record information you and your builder need to hold onto for close-out.

Those thresholds come from Schedule 1 of the Building Act 2004 — which sets out exemptions for building work that doesn’t require a building consent.

Two things catch people out.

Exempt doesn’t mean unregulated. Work on the exempt list still has to meet the Building Code. The exemption removes the building consent process, not the standard — and the gap between those two can show up years later, particularly when a property changes hands.

And a building consent isn’t the only consent. Your project might still need resource consent for the same job, depending on the zone, any overlays, and where it sits relative to your boundaries.

Two houses on the same street can have completely different building constraints.

Site coverage, height in relation to boundary, yard setbacks, drainage, easements, overlays and site-specific conditions can all affect what’s possible — and none of it is obvious from the footpath.

This is why we recommend a Build & Feasibility Review before you commit too far to plans, quotes or a building contract.

We look at whether the proposed design is realistic to build, the likely consent pathway, what documentation may be required, and what needs to happen first, second and third.

Most reviews are completed within a few working days. It’s a relatively small step early on that can help avoid expensive redesign and delays later.
