In 𝐀𝐧𝐧𝐚𝐛𝐞𝐥𝐥 𝐌𝐚𝐥𝐢𝐜𝐥𝐢𝐜 𝐯. 𝐏𝐞𝐨𝐩𝐥𝐞 𝐨𝐟 𝐭𝐡𝐞 𝐏𝐡𝐢𝐥𝐢𝐩𝐩𝐢𝐧𝐞𝐬, 𝐆.𝐑. 𝐍𝐨. 𝟐𝟖𝟎𝟕𝟐𝟕, 𝐅𝐞𝐛𝐫𝐮𝐚𝐫𝐲 𝟒, 𝟐𝟎𝟐𝟔,the Supreme Court modified the conviction of a 25-year-old aunt who forced her 11-year-old nephew into se*xual inter*course. While the lower courts convicted her of "lasci*vious conduct" under R.A. No. 7610 the Supreme Court ruled that because the victim was under 12 years old and legally incapable of consent, the proper crime is Statutory Acts of Lasc*iviousness under Article 336 of the Revised Penal Code.

Applying the recent 𝙂𝙧𝙖𝙢𝙖𝙩𝙞𝙘𝙖 𝙫. 𝙋𝙚𝙤𝙥𝙡𝙚 doctrine, R.A. No. 7610 applies when a minor gives a semblance of consent (albeit flawed or coerced) to an adult. It does not apply where a minor is completely incapable of giving legal consent due to age. Because Karl was 11 years old in 2018 (below the then-age of consent of 12), he could not consent. Under Section 5(b) of R.A. No. 7610, offenses against children under 12 must be prosecuted under the RPC, but with the specific penalty prescribed by R.A. No. 7610 (reclusion temporal in its medium period).

The Supreme Court noted that under the law active at the time of the offense, Annabelle COULD NOT be charged with R@pe via car*nal knowledge because the wording STRICTLY penalized "𝗮 𝗠𝗔𝗡 𝘄𝗵𝗼 𝘀𝗵𝗮𝗹𝗹 𝗵𝗮𝘃𝗲 𝗰𝗮𝗿𝗻𝗮𝗹 𝗸𝗻𝗼𝘄𝗹𝗲𝗱𝗴𝗲 𝗼𝗳 𝗮 𝘄𝗼𝗺𝗮𝗻." Because the perpetrator was a woman and the victim a male, a historical legal loophole prevented her from being charged with r@pe.

Even though R.A. No. 11648 (passed in 2022) updated the wording to "𝙖 𝙋𝙀𝙍𝙎𝙊𝙉 𝙬𝙝𝙤 𝙨𝙝𝙖𝙡𝙡 𝙝𝙖𝙫𝙚 𝙘𝙖𝙧*𝙣𝙖𝙡 𝙠𝙣𝙤𝙬𝙡𝙚𝙙𝙜𝙚 𝙤𝙛 𝙖𝙣𝙤𝙩𝙝𝙚𝙧 𝙥𝙚𝙧𝙨𝙤𝙣," Justice Leonen pointed out that conservative Philippine jurisprudence still stubbornly defines "car*nal knowledge" as the pe*******on of a female organ by a male organ, effectively attributing the act of pe*******on solely to men.

These views on r@pe, according to the SC, are not only misogynistic, they also disenfranchise male victims who have less redress in law, but are inflicted with the same trauma. Further, the lack of recognition that males can be victims also impairs their ability to recognize that they have been violated in the first place.

Isang taos-pusong pagbati sa ating Barangay sa pagkakamit ng karangalan bilang Best VAWC Officer at Best VAWC Room para sa taong 2025 Validation! 🎉

Ang pagkilalang ito ay patunay ng ating patuloy na dedikasyon at malasakit sa pagsulong ng karapatan at kapakanan ng kababaihan at mga bata sa ating komunidad. Sa pangunguna ng ating VAWC Officer Mar-Vina Reynon Melendres Jhoerjean Nudalo at sa suporta ng buong pamunuan ng barangay sa pangunguna ng Punong Barangay Reynaldo Go Jr. matagumpay nating naipakita ang maayos, ligtas, at makataong serbisyo para sa mga biktima ng karahasan.

Lubos po ang aming pasasalamat sa lahat ng nakibahagi at sumuporta—sa ating mga kawani, volunteers, at mga kabarangay. Ang tagumpay na ito ay para sa ating lahat!

VAWC On-Site Validation 2026 (For CY 2025)

Isinagawa ang On-Site Validation para sa Violence Against Women and Their Children (VAWC) ngayong taong 2026, bilang pagsusuri sa mga programang ipinatupad para sa Calendar Year 2025.

Layunin ng gawaing ito na matiyak ang maayos na pagpapatupad ng mga polisiya, serbisyo, at programa na naglalayong protektahan ang kababaihan at kanilang mga anak laban sa anumang uri ng karahasan.

Patuloy ang ating barangay sa pagsusulong ng isang ligtas, maayos, at makataong komunidad para sa lahat. 💜

In 𝐏𝐞𝐨𝐩𝐥𝐞 𝐨𝐟 𝐭𝐡𝐞 𝐏𝐡𝐢𝐥𝐢𝐩𝐩𝐢𝐧𝐞𝐬 𝐯. 𝐙𝐙𝐙, 𝐆.𝐑. 𝐍𝐨. 𝟐𝟔𝟔𝟕𝟎𝟔, 𝐉𝐮𝐧𝐞 𝟐𝟔, 𝟐𝟎𝟐𝟒, the SC ruled that in instances of ra*pe committed through force, th*eat, or intimidation, there is no requirement to prove that the victim resisted. The SC clarified that previous decisions stating that a woman cannot claim to be a ra*pe victim unless she fought back are INCONSISTENT with the current legal framework. These earlier pronouncements often reinforce misguided stereotypes that contribute to gender bias and insensitivity. It is essential to recognize and respect women’s rights to autonomy and bodily integrity.
