What is an appellate decision?

After reviewing the issues raised on appeal, an appellate court issues a decision resolving the appeal. Depending on the case, the court may affirm, reverse, modify, or send the matter back to the lower court for further proceedings.

The decision determines what happens next in the case.

What is an appellate brief?

An appellate brief presents a party's written arguments to an appellate court, addressing the legal issues raised on appeal and the law supporting that party's position.

What is a standard of review? ⚖️

A standard of review is the framework an appellate court uses when evaluating a particular issue or decision from a lower court.

Different issues may be reviewed under different standards. In some situations, an appellate court examines a legal question independently. In others, the court gives greater deference to decisions made by the lower court.

The applicable standard can affect how an appellate court analyzes the arguments raised on appeal and what must be shown for a lower court's decision to be changed.

What does an appellate court review? ⚖️

An appellate court generally reviews the record created in the lower court to determine whether a legal error occurred that affected the outcome of the case.

It generally does not hear new evidence, call new witnesses, or retry the case. Depending on the issues raised, the court may review questions involving the interpretation or application of law, procedural rulings, or other decisions made during the lower court proceedings.
