The Second Edition of my Louisiana DWI book is now available.
Several years ago, I wrote DWI: Practical Information for the Accused and Attorneys in Louisiana. The goal was pretty simple: explain Louisiana DWI law in a way that people could actually understand.
A lot has changed since then. Louisiana DWI laws have changed, and I've continued representing people charged with DWI throughout the state. I've also learned a lot from the questions and misunderstandings I hear from clients every day.
So it was time for an update.
The Second Edition covers Louisiana DWI penalties, driver's license suspensions, administrative hearings, breath and blood testing, test refusals, ignition interlock requirements, first and repeat offenses, and other issues that can come up after a DWI arrest.
I'm also making the digital edition available free through our website. You don't have to buy the book to read it.

First DWI in Louisiana? The Law Says 10 Days to 6 Months in Jail
A lot of people think you can't go to jail for a first DWI in Louisiana. That's not what the law actually says. If you are convicted of a first-offense DWI, the law says the sentence is 10 days to six months in jail. Yes, the minimum sentence starts at 10 days. But that does not mean everyone convicted of a first DWI actually spends 10 days in jail.
Louisiana First DWI Jail Time | 10-Day Minimum Explained A first-offense DWI in Louisiana carries 10 days to six months in jail. Learn how probation can suspend jail time and what conditions may apply.

MYTH: If you weren't driving, you can't be arrested for DWI.
FACT: In Louisiana, a person can be charged with DWI even if the vehicle is parked. The legal issue is whether the prosecution can prove the required operation or control under the circumstances—not simply whether the vehicle was moving. Therefore, if the vehicle is parked, but turned on, that is operation.

MYTH
"If the police officer didn't read me my Miranda rights, my DWI case will be dismissed."
❌ FALSE
Miranda warnings are not required every time a person is stopped or arrested.
In many Louisiana DWI cases, statements made during a roadside investigation may still be admissible because a routine traffic stop is generally not considered "custodial interrogation" for Miranda purposes.
Every case is different, and whether a statement can be used depends on the specific facts and circumstances.
Don't rely on internet myths when making decisions about your case.
🚔 **True or False?**
"If you blow under a .08 in Louisiana, the police can't arrest you for DWI."
❌ False.
This is probably one of the biggest misconceptions I hear.
Many people believe .08 is a "safe" number that prevents an arrest. It doesn't.
In Louisiana, an officer can still arrest someone for DWI if the officer believes the person's ability to operate a vehicle is impaired—even if the breath test result is below .08.
Every case is different, and the facts matter.
