Think L-1A is out of reach because your company is small? Let’s clear this up.

Here’s what you actually need to know.

First, what’s true:
✅ There’s no company size or revenue requirement for L-1A.
✅ What’s required is a qualifying relationship between a U.S. company and a related foreign entity.
✅ The transferring employee needs at least one continuous year abroad in a managerial or executive role, within the past three years.

Here’s what actually determines eligibility:
→ The ownership and control structure between the two companies
→ Whether the position is genuinely managerial or executive, beyond the job title
→ For new U.S. offices, whether the business can support that role within the first year

Worth knowing:
→ New office petitions typically get a shorter initial approval period and closer scrutiny.
→ L-1A can lead to a green card through EB-1C, without needing a PERM process.

Small doesn’t mean disqualified. It just means the structure needs to be reviewed properly.

If your green card depends on PERM, the process you know might not exist much longer.

Here’s what’s actually going on.
First, what’s confirmed:
✅ No final rule has been published yet
✅ This is currently on the DOL’s regulatory agenda, not an active law
✅ The PERM process as it works today is still what’s being used right now

What the DOL is proposing to change:
→ Recruitment methods: moving from print newspaper ads to digital and online platforms
→ Labor market testing: stricter review of job requirements and recruitment results
→ U.S. worker protections: closer scrutiny of layoffs and hiring practices
→ Documentation: expanded recordkeeping and broader audit authority

Worth knowing:
→ This would affect employment-based green cards filed through EB-2 and EB-3
→ A formal proposed rule with a comment period hasn’t been released yet, but it’s expected soon
→ If it moves forward, PERM could take longer and require more documentation from your employer
