On June 23, 2026, the Massachusetts Supreme Judicial Court ruled that a proposed statewide rent control initiative will not appear on the November 2026 ballot. The decision was based on a technical issue in the petition’s wording, related to a religious exemption, and not on whether rent control itself is legal or appropriate.

The proposal aimed to repeal the state’s 1994 ban on rent control and allow cities and towns to limit rent increases to 5 percent or inflation, whichever is lower. With the measure removed, the current statewide ban on rent control remains in place, and there are no immediate changes for landlords, tenants, or housing investors.

Housing advocates are expected to continue pushing for revised ballot language or new legislation that could allow local rent regulation. Industry groups that opposed the measure say the ruling helps maintain stability in the current housing market.
