Advanced estate planning works best before a crisis forces the conversation.

A business owner may spend decades building a company, acquiring real estate, and creating substantial family wealth. Then a serious diagnosis changes the timeline.

Suddenly, the family wants to restructure ownership, transfer assets, begin gifting, or establish a Family Limited Partnership (FLP).

“If I die without an estate plan, the government will just divide everything fairly.”

That assumption can create serious consequences for a family.

In Texas, when someone dies without a valid will, Texas intestacy laws determine who inherits the probate estate based on legal rules — not necessarily based on personal relationships, family dynamics, or what the person verbally intended.

Your college checklist may be missing something more important than a laptop or dorm supplies.

Once your child turns 18, they are legally an adult. That means parents generally no longer have automatic authority to make medical or financial decisions for them — even if they’re still in college and still depend on you.

In an emergency, having the appropriate documents in place can make an important difference.

Depending on their circumstances, a young adult’s legal protection plan may include:

• Medical Power of Attorney
• Durable Financial Power of Attorney
• HIPAA Authorization
• Advance Directive, when appropriate

College preparation shouldn’t only be about what they need for the dorm.

It should also be about making sure the right people can help when it matters most.

Dolly Parton’s legacy was never just about what she owned. It was about what she built to outlast her.

She had no children. Her husband of nearly six decades, Carl Dean, passed away in 2025. Yet the impact she created extended far beyond a traditional family inheritance.

Her music, intellectual property, business interests, Dollywood, charitable work, and especially the Imagination Library created a legacy capable of touching lives long after her own lifetime. The Imagination Library alone has distributed hundreds of millions of books to children around the world.

And that illustrates an important estate-planning lesson:

You do not need children — or extraordinary wealth — to need a plan.

Estate planning can help you decide who should receive what you have built, who should have authority if you become incapacitated, how business and intellectual-property interests should be handled, which people or organizations you want to support, and what kind of legacy you want to leave behind.

Inherited property doesn’t always mean “tax-free.” But which taxes actually apply?

When property passes to you, there are three different tax concepts you may hear about:

1. Estate Tax
This is generally paid by the estate, not directly by the beneficiary. Texas does not currently impose a state estate tax, but federal estate tax may apply to estates that exceed the applicable federal exemption.

2. Inheritance Tax
Texas does not impose a state inheritance tax. However, inheritance tax exists in a small number of other states, so the circumstances of the estate can matter.

3. Capital Gains Tax
If you later sell inherited property, capital gains tax may apply. In many cases, inherited property receives a step-up in basis to its fair market value at the date of death, which can significantly affect the taxable gain when the property is sold.

The key takeaway?
Receiving an inheritance and selling inherited property are two different tax events — and proper planning can make a significant difference.
