2026년 9월 15일부터 F-1 학생들은 기존의 D/S 방식 대신, 일반적으로 최대 4년의 고정된 체류기간을 부여받게 됩니다.

현재는 학교에서 I-20를 연장하거나 새로 발급받아 학업을 계속하는 방식으로 F-1 신분을 유지하는 경우가 많습니다.

그러나 새로운 규정에서는 허용된 F-1 체류기간이 끝나면 새로운 I-20만으로는 충분하지 않을 수 있으며, USCIS에 Form I-539를 제출하여 F-1 신분 연장을 신청해야 할 수 있습니다.

⚠️ 특히 EB-2/EB-3 취업이민 신청자들에게 중요한 문제입니다.

I-140이 승인되었더라도 Priority Date가 Current가 될 때까지 2~4년 이상 기다려야 하는 경우가 많습니다.

🚨 F-1 학생 신분에 중요한 변화 — 특히 EB-2/EB-3 영주권 신청자 주의

2026년 9월 15일부터 F-1 학생 신분 제도에 중요한 변화가 시행됩니다.

현재 대부분의 F-1 학생은 D/S (Duration of Status) 방식으로 체류하며, 정상적으로 학업을 계속하는 한 학교에서 I-20를 연장하여 신분을 유지할 수 있습니다.

하지만 새로운 제도에서는 F-1 학생에게 고정된 체류기간이 부여되고, 일반적으로 최대 4년까지 허용됩니다.

그 기간을 넘어 체류하려면 단순히 새로운 I-20를 받는 것만으로는 부족할 수 있으며, USCIS에 Form I-539를 제출하여 F-1 신분 연장을 신청해야 할 수 있습니다.

⚠️ EB-2/EB-3 영주권 신청자에게 특히 중요한 이유

영어교육 프로그램(ESL)의 경우 F-1으로 받을 수 있는 기간에 총 24개월 제한이 적용됩니다.

따라서 “Priority Date가 Current가 될 때까지 계속 ESL에 등록하면서 F-1을 유지하면 된다”는 방식은 앞으로 매우 어려워질 수 있습니다.

또한 대학이나 대학원 과정도 USCIS가 실제 학업 목적이 있는지, 아니면 단순히 영주권 순서를 기다리기 위해 학교에 등록한 것인지 더 면밀히 검토할 가능성이 있습니다.

F-1 체류기간이 끝나기 훨씬 전부터 신분유지 전략을 준비하는 것이 중요합니다.

🚨 Important F-1 Change — Especially for EB-2/EB-3 Applicants

Beginning September 15, 2026, F-1 students will generally be admitted for a fixed period of up to 4 years, instead of the current D/S system.

Under the current system, students can often continue their studies by obtaining a new or extended I-20 from the school.

Under the new rule, once the authorized F-1 period expires, a new I-20 alone will not be enough. The student may need to file Form I-539 with USCIS to extend F-1 status.

⚠️ This is especially important for EB-2 and EB-3 applicants.

Many applicants have an approved I-140 but must wait 2–4 years or longer for their Priority Date to become current before they can file I-485.

A potential problem:

F-1 expires → Priority Date is not current → I-485 cannot yet be filed → F-1 extension must be requested from USCIS.

This may be particularly difficult for students relying on ESL or repeated school enrollment simply to maintain status. The new rule also places significant restrictions on long-term English-language programs.

EB applicants maintaining F-1 status should now carefully review:
