People keep asking what Texas law “says” about the Alaska surrogate who gave birth in Dallas.
Two issues got stacked on top of each other.
One was whether a medically fragile newborn would get treatment. That was addressed. Hospitals treated. Surgery happened.
The other is parentage. A California court already named the intended parents. The surrogate asked a Dallas family court to treat her as the mother because the birth occurred here. On September 2, the Dallas judge credited the California judgment and dismissed her from the Texas case. She has now asked the U.S. Supreme Court to pause that order.
That is where the file sits this morning.
Multi-state parentage cases turn on the contract, the forum, and full faith and credit — not on who gave the better interview.
