On Constitution Day, we celebrate the document that established the framework for our nation’s laws, rights, and system of justice.

New Jersey Manufacturers (NJM) NJM Insurance Group insures a defendant who rear-ended our client, Mr. Cespedes’, vehicle. NJM waited three years to make an offer on the defendant’s behalf: $75,000 from a $300,000 policy. Salomao Nascimento, Esq., Ed McElroy, Esq., and Daniel N. Epstein, Esq. spent the last few weeks preparing the case for trial. NJM’s offer was only 25% of the coverage limit.

We rejected the offer without a counteroffer. Our demand was the policy limit from the start of the case, and we advised the carrier that it would remain our demand until trial began. We were clear: At that point, our client would not accept even the policy limit, and we would wait to see what the jury had to say. The defense lawyer communicated our position to the adjuster, who presumably advised the carrier’s higher-ups.

With the jury waiting to be selected, the defense lawyer received a call from the NJM adjuster and communicated NJM’s penultimate offer: “If I can get them [NJM] to give you $250,000, would you take it?”

We had discussed this possibility in advance with our Spanish-speaking client, so we knew how to respond: “NO.”

The carrier, the adjuster, and the defense lawyer all knew that if they wanted to eliminate the defendant’s exposure to an excess judgment, they would have to give us every penny of the policy.

At 12:30 p.m., we went to lunch. At 1:30 p.m., NJM caved and offered all the money remaining on the policy, and the case was settled.

On our terms. On our client’s terms.

It’s not so much a mantra as it is a mission, and we see the opportunity to fulfill it in every trial we win or that they pay us not to try:

“FIGHT HARDER.”
