™️ What Does the TM Symbol Actually Mean?

You’ve probably seen ™ next to a business name, logo, or slogan. But what does it actually mean?

The ™ symbol indicates that someone is claiming a word, name, phrase, or logo as a trademark. You don't need to have a federally registered trademark to use it.

One important distinction:

™ does NOT mean your trademark is federally registered.

The symbols generally break down like this:

™️ TM — Used for an unregistered trademark, typically for goods.

℠ SM — Used for an unregistered service mark.

®️ ® — Reserved for trademarks that have been federally registered with the USPTO.

So, if you're using a brand name but haven't received federal registration, ™ is generally the appropriate symbol.

📌 What does ™ actually accomplish?

It puts others on notice that you consider the name, logo, or phrase to be your trademark. However, simply adding ™ doesn't automatically create exclusive nationwide rights or guarantee that you have superior rights to the mark.

Trademark rights can exist through use in commerce, but unregistered rights are generally more limited than the rights provided by federal registration.

And one important rule: Don't use ® just because you've filed an application. You can use ® only after the trademark has actually been registered.

The takeaway:

® means “This trademark is federally registered.”

🔎 What does the USPTO actually do when you file a trademark?

The USPTO (United States Patent and Trademark Office) is the federal agency responsible for registering trademarks and patents in the United States.

When you file a trademark application, a USPTO examining attorney reviews it to determine whether it meets federal requirements. But there’s one important thing many new trademark applicants don’t realize:

The USPTO does not search for conflicts for you before you file.

The USPTO provides a free Trademark Search tool, but a basic federal search is only one piece of the puzzle.

A potential trademark conflict could involve:

• A federally registered trademark
• A pending application
• A state trademark registration
• An unregistered mark with established common law rights
• A similar-sounding or similarly spelled name
• A mark used with related goods or services

And even if you don't find an identical trademark, that doesn't necessarily mean your mark is available.

📌 The takeaway: A USPTO search can be a useful starting point, but trademark availability involves more than finding an exact match in the federal database.

Before filing, know what you're searching for and understand what the USPTO will (and won't) do for you.

🚨 Filed a trademark application and got a suspicious phone call shortly afterward? It may be a scam.

Trademark applicants are increasingly being targeted by scammers who obtain information from newly filed applications and then pose as government officials.

One common scam looks like this:

📞 You file your application with the USPTO.
📞 Minutes later, someone calls claiming to be from the “Patent & Trademark” office.
💰 They tell you that your filing fee only covered your goods and that you owe thousands more for something like “Global Authority” or “global trademark protection.”

That’s not how the USPTO works.

Scammers may even spoof a real USPTO phone number, making the call appear legitimate. You may also receive a follow-up email from a recently created domain designed to look official.

🚩 Red flags to watch for:

• A phone call demanding additional trademark fees
• Claims that you need a “global trademark” through the USPTO
• Requests for payment or personal information over the phone
• Caller ID showing an official-looking government number
• Emails from anything other than an .gov address
• Urgent requests to call a number or click a link

🛑 If you receive a suspicious call:

Hang up. Don't call back using the number provided by the caller.

Check your application directly through the USPTO's official website and TSDR system. If you need to contact the USPTO, find the contact information independently rather than using information provided by the caller.

And remember: There is no single “global trademark” issued by the USPTO. Trademark protection is jurisdiction-specific.

If you already provided payment information, contact your bank or credit card company immediately and report the fraud.

The best defense is knowing what the real trademark process looks like. When you understand what to expect, it's much easier to recognize when something doesn't look right.
