Federal prosecutors say there are no current plea negotiations with defendants Joshua Allen and Michael Cox in the ongoing criminal case tied to what prosecutors have described as an alleged Ponzi scheme.

Both men, through their attorneys, have indicated they intend to go to trial—and prosecutors say while they could still plead guilty to the indictment, the U.S. is not offering a plea agreement right now. The court is also weighing steps for what could be a lengthy trial (potentially up to three weeks).

When asked if Ferrum Capital was a Ponzi scheme — he invoked his Fifth Amendment right rather than answer.

When asked if he pocketed $13 million from investors — he invoked his Fifth Amendment right rather than answer.

He did so more than 490 times.

Now, a court-appointed receiver is asking a San Antonio judge to immediately freeze more than 40 businesses tied to Lubbock's Joshua Allen — before more than 300 people, many right here in West Texas, may have nothing left to recover.
