Don’t guess. Get the facts before you head to the polls.
*In Texas, individuals held in county jails retain their legal right to vote as long as they are not currently serving a sentence for a final felony conviction. Under Texas law, criminal charges alone do not take away a person's voting rights.
An individual confined in a Texas jail can legally vote if they meet general voting requirements (U.S. citizen, Texas resident, at least 18 years old, and mentally competent) and fall into one of the following categories:
Pre-trial Detainees: Individuals who have been arrested and are awaiting trial but have not yet been convicted of a crime.
Misdemeanor Convictions: Individuals serving a sentence in a county jail solely for a misdemeanor offense.
Felony Convictions on Appeal: Individuals convicted of a felony who are actively appealing their conviction. In Texas, a conviction is not legally considered "final" until all direct appeals are officially exhausted*
