New Blog: "The Last Mile of Estate Planning: Why Deed Transfers Break Down in a 50-State Practice — and How to Fix It" by Eve Gu, Esq.

There's a line in a lot of estate planning files that should worry us more than it does, "Delivered to Client for Recording." It closes the matter. It satisfies the checklist. And it's cold comfort when the property surfaces in probate five years later because the client signed on the wrong line, used a notary who omitted required language, or simply put the envelope in a drawer.

The uncomfortable part is that the alternatives aren't much better. Researching another state's ex*****on formalities and transfer tax forms costs hours you can't bill, and the research goes stale before the next client — whose property will be somewhere else entirely. Engaging local counsel for a routine trust-funding deed means finding a firm willing to take a $500 matter, waiting days, and paying rates that dwarf the task.
