PJM filed its Reliability Backstop proposal with FERC on July 31.

Three weeks late. The clock is running.

Here is what our panel of PJM and state regulatory experts that include Jonathan Sasser, Ann Yu, Ian Sneed, and Madelon Kuchera walked away saying:

→ Our panel expects FERC approval given PJM’s mandate to complete the auction before midterms, but a delay of 1-3 months is possible. Outright rejection pushes the auction into 2027.

→ Cost allocation is not as settled as PJM’s language suggests. The real decisions on how costs land on your organization will be made state by state.

→ Whether a hyperscaler or its load-serving entity becomes the contracting counterparty for BYONC comes down to one question: who owns and operates the site. Self-developed sites with MBR authority contract directly. Third-party-leased sites will likely lean on the LSE.

→ Do not count on Washington to close the supply gap. Our panel does not believe federal intervention could get new generation built fast enough to matter in the next 1-2 years. Large loads need to plan around managing their exposure now.

→ Upstream transmission cost allocation is a state fight, not a PJM one. Watch what happens in your state proceeding.
