Goldwater Institute
We're working daily in state courtrooms, legislatures, and communities nationwide to empower people to live freer, happier lives.
Founded in 1988 with the blessing of the late Senator Barry Goldwater, the Goldwater Institute’s mission is to advance freedom and protect the Constitution. As a non-profit organization funded solely by individual donations, we stand on principle, not politics. We believe in the power of the states to restore America to the founding principles that made it a beacon of opportunity, prosperity, and freedom. We research and develop ideas that help states use their constitutional powers to protect their citizens’ liberties. And when governments overstep their constitutional authority, the Goldwater Institute defends citizens in court. The Goldwater Institute is staffed by the brightest minds in economics, education, and constitutional law. An advisory panel of Senior Fellows adds breadth of knowledge and expertise. The Goldwater Institute is a 501c(3) organization and accepts only private donations, not government funding or contract research. We have contributors from all 50 states and no single contributor provides more than five percent of revenue.

Pima County’s new data center moratorium is illegal, and the Goldwater Institute is taking action to stop it.
The county has imposed a sweeping ban on new data center development, even though its own public-health review found a “lack of direct empirical evidence” of health impacts in communities near data centers.
Now, the Goldwater Institute is demanding county officials immediately rescind the moratorium.
Arizona law sets strict limits on when local governments can freeze otherwise lawful development—and Pima County hasn’t met those requirements. The moratorium could also leave taxpayers on the hook for violating property owners’ rights.
Legitimate concerns about development can be addressed through clear, generally applicable rules. What government cannot do is arbitrarily halt lawful development while it decides what rules it might want to impose.

In 1824, nearly 50 years after he fought alongside the American revolutionaries, the legendary French hero Marquis de Lafayette returned to the United States for an extraordinary journey through the young nation he had helped create.
Historian and author Richard Brookhiser describes his triumphal tour of early America in his new book The Hero Returns: Lafayette and the Legacy of Revolution—and you can join the Goldwater Institute’s Timothy Sandefur for a special webinar discussion with the author as they discuss the life of Lafayette and the lessons he can teach us in America’s 250th year.

Yesterday we filed a suit against the Tennessee School Boards Association for the second time. In 2020, we won the case requiring the TSBA to follow Tennessee's open records law. Now, they're trying to undo that win.
With our friends at the Goldwater Institute, we're back in court to make sure an organization that runs on taxpayer dollars can't hide from the public. Learn more about the case here 👉

Millions of Americans already struggle to reach a pharmacy. New ownership restrictions could make that problem worse.
A new Goldwater Institute report notes that 57.1 million Americans already live in pharmacy deserts, while another 28.9 million rely on a single pharmacy whose loss could leave them with similarly limited access.
Lawmakers are right to scrutinize abusive practices in the prescription drug market. But forcing companies to sell or shutter pharmacies could disrupt care—particularly in rural and underserved communities—without addressing the underlying misconduct.
Health care reform should make care more available, not harder to reach. See link below for more!

Arizona has lost one of its most consequential public servants. Former Senator Jon Kyl has passed away at the age of 84.
Senator Kyl, who represented our state in Congress for more than 26 years, serving first in the U.S. House and later rising to become the second-ranking Republican in the Senate. He earned a reputation as a serious lawmaker who viewed public service as a responsibility and the defense of liberty as its central purpose. Senator Kyl brought that approach to some of our nation’s—and Arizona’s—most difficult challenges.
Senator Kyl’s influence was also instrumental in establishing the Goldwater Institute. He helped found the organization in 1988 and remained a trusted friend and adviser as it grew into a national defender of individual liberty and limited government.
“The Goldwater Institute would not be the organization it is today without Jon Kyl and the leadership he demonstrated during his more than 26 years of public service,” Goldwater Institute President and CEO Victor Riches said.
Kyl studied the issues, defended his convictions and treated public office as a duty rather than a platform for personal attention. He leaves Arizona—and the Goldwater Institute—with an enduring example of principled leadership.

Twenty-five years ago, terrorists attacked our nation, our freedoms, and our way of life. The Goldwater Institute remembers the innocent lives that were taken, and we honor them by remaining steadfast in the defense of liberty.
