Under Texas law, an oral agreement, month-to-month arrangement, or informal rental situation can still create a tenancy. That means a landlord usually cannot simply remove the occupant without following the proper eviction process.

Montgomery County Eviction: Which JP Court Handles Your Case?
Montgomery County Eviction Court: 5 JP Courts, and One Has Two Locations
Montgomery County has five Justice of the Peace courts, one for each precinct — Precinct 1 through Precinct 5. That's far simpler than Harris County's sixteen, but it comes with a wrinkle most landlords don't expect.
Precinct 1 operates out of two separate courthouses, one in Willis and one in Montgomery. Same precinct, same judge, two buildings. If you show up at the wrong one, your hearing is happening somewhere else.
Montgomery County covers a lot of ground — from Magnolia in the west to New Caney in the east, from The Woodlands in the south to Willis in the north. The courthouse nearest your office is often not the one with jurisdiction over your rental.
Why the precinct decides the case
Each Justice Court handles its own filings, dockets, and procedures. The precinct is determined by the physical address of the rental property — not where you live, not where your property manager is based, not the closest courthouse to you.
File in the wrong precinct and the case isn't rerouted. It's subject to dismissal. You refile in the correct court, wait for a new hearing date, and lose another month of rent.
If your tenant appeals
Appeals from all five Montgomery County Justice Courts go through the County Clerk, and civil appeals are heard in County Court at Law. That's a different court, different deadlines, and a filing fee paid to the County Clerk.
Justice Court clerks are also not permitted to give legal advice. They can hand you a form. They can't tell you whether your notice is valid or which precinct covers your property.
