Cryptocurrency is one of the easiest assets to overlook in a divorce, and one of the hardest to hide well.
It does not show up on a standard asset statement the way a bank account does. There is no monthly paper statement arriving at the house. That leads some people to assume it is invisible.
It is not. Exchange records, tax filings, and bank transfers into an exchange all leave a trail. So do wallet addresses once they are identified.

A prenup is not a prediction that your marriage will fail.
It is a conversation about money that most couples never have until they are forced to, usually at the worst possible moment.
What a marital agreement can do in Colorado: define what stays separate property, address how you handle debt each of you brings in, and set expectations around a family business or inheritance.
What it cannot do: decide child custody or waive child support. Colorado courts will not enforce that, because those decisions belong to the child's best interests at the time, not to an agreement signed years earlier.
The couples who handle this well treat it as planning, not as suspicion.

Colorado does not have a seven year rule for common law marriage.
That number gets repeated constantly and it is not in the law. Living together for a decade does not automatically marry you, and living together for two years does not automatically protect you either.
What Colorado courts actually look at is whether you two held yourselves out as married. Joint finances. Shared last names. How you introduced each other. Whether you filed taxes together.
It matters because if a court finds a common law marriage existed, you get a divorce, property division, and potentially spousal support. If it finds there was none, you may walk away from a long relationship with nothing.

If your existing order is more than a few years old, the calculation the court would use today may look meaningfully different from the one you have on paper.
The point is not to run every existing order back through the system. It is to know:
β Whether your circumstances have changed enough to justify a modification
β Whether the new framework helps or hurts you
β Whether it is worth the time and cost to open the case back up

The court is not counting years - it is looking at intent and conduct. Did you both mean to be married. Did you present yourselves that way. Did you share the things married couples share.

It is a fair question to ask. Digital assets are not going away, and the rules around discovery, valuation, and division are still evolving. An attorney who has never worked a case with meaningful crypto exposure will miss things - sometimes expensive things.
Questions worth asking any lawyer you are considering:
β How do you approach discovery on self-custody wallets
β How do you fix a valuation date on a volatile asset
β How do you handle assets held on foreign exchanges
β How do you preserve records when the other side controls the keys
