That little speeding ticket can follow you a lot longer than the flashing lights do.
Thereās been a lot of conversation locally about new law-enforcement technology. Wichita is using a growing network of Flock license-plate reader cameras and Andover uses technology including radar equipment to identify areas with speeding problems and step up enforcement. Quick clarification: As we understand it, flock cameras themselves are not speed cameras issuing automatic tickets. There is a bigger takeaway is though....Technology is making it easier than ever for law enforcement to identify vehicles, analyze traffic patterns, and focus enforcement where problems are happening. This will matter to your insurance.
A speeding conviction can show up on your driving record and insurers likely will use moving violations as a factor when determining your auto insurance rate. So that āI was only going a little overā ticket, may have a second price tag to pay later when your insurance renews.
Unfortunately, saying: āBut I was keeping up with traffic!ā has never appeared on an insurance-company discount list. š Drive safe, slow it down a little because it just got easier to catch you! Remember, the cost of a speeding ticket may last longer than the ticket itself.

A long time customer of ours asked today, āWhy does my insurance company care what I have in my yard?ā
Sometimes a carrier sends a letter asking that something on the property be repaired, cleaned up, secured or removed. The wording can feel pretty abrupt and in their legal-ease lack any customer service, especially when it jumps quickly to āpossible non-renewal.ā
The insurance carrier isn't trying to scare anyone or be rude Their real concern is the liability. In insurance, an āattractive nuisanceā is a condition or item on a property that could draw someone in, especially a child, and create a risk of injury. More broadly, carriers also look at conditions around a property that may increase the chance of someone getting hurt. That can include things like areas in disrepair, unsecured equipment, damaged structures like playground equipment or other hazards that may not feel dangerous to the homeowner but look different from a liability standpoint.
What should you do if you get one of these "nastygrams" from your carrier? Don't ignore the letter. Send it to us, your local agent. We can help translate what the carrier is asking for, determine whether there is a simple fix, and help you understand your options before it becomes a bigger issue.
Sometimes the letter sounds a lot scarier than the solution actually is!

āMost of my clients are friends. Theyād never sue me.ā This is what a new referral partner of mine told me today. He's been operating for several years and built much of his business by helping friends and people he knows. Now that heās growing, he finally purchased an E&O policy because heās worried the risk is getting bigger.
Iām glad he bought it. Really glad. That being said, there is something bigger worth talking about here: E&O coverage matters from the beginning, not just when your business takes off.
Professional Liability, or Errors & Omissions insurance, is designed to help when a client claims your advice, your service, your mistake, or missed detail or failure to act caused them financial harm.
Sometimes the hardest claims come from people you know and it isn't because they suddenly become terrible people. It is because money changes things. A friend may love you, trust you, and still be facing a $50,000 loss...At that point, the conversation stops being, āDonāt worry, I know them.ā It starts to be, āWho is responsible for this?ā Moreover, when your friends do blame you, they expect you to step up.
Growth absolutely increases exposure. More clients, more transactions, more employees, and more complexity generally mean more opportunities for something to go wrong. But your first client can create an E&O claim just as easily as your 500th. I'd almost argue it is more likely to happen in the beginning when you are less adept at stepping over professional landmines.
The time to think about Professional Liability is not when you finally feel big enough to get sued. Itās when you first start giving advice, providing a professional service or making decisions that someone else could rely on financially. Being small doesnāt mean you have no exposure. It may just mean you have less money available to survive the lawsuit.
If youāre building a business around your expertise, E&O should be part of the conversation early, not someday when you āget bigger.ā Make it part of your plan from the get-go.
