The Constitutional Court’s Van Wyk judgment means the old separation between “maternity leave” and “paternity leave” no longer reflects the law as it stands.

The new rules apply now — not only once Parliament finalises legislation.

Employers should review leave policies, employment contracts, HR systems, payroll categories, and benefit arrangements without delay.

The new annual threshold is R269,600.90 — and employees who were previously above the old threshold may now fall below the new one.

That means they may now qualify for statutory working time protections your payroll may not yet reflect.
