A New York lawyer asked ChatGPT to find him some case law. It found six cases. Names, citations, quotes, the works. None of them existed.

When he got nervous, he asked ChatGPT whether the cases were real. ChatGPT said yes. That was the entire fact-check.

The judge could not find the cases either, for the fairly solid reason that they were fiction. The lawyers were fined $5,000 and became the most famous cautionary tale in legal history.

The lesson is not "never use AI". It is: AI that answers from thin air will answer confidently from thin air. An agent wired to your real documents, prices and policies has nothing to invent.

Here is a test that settles most automation arguments in ten seconds.

A human cashier who mishears you gets corrected once. An automated system with no graceful way out will compound the mistake with perfect confidence, at machine speed.

A courier company's support chatbot got talked into swearing at a customer. Then it composed a short poem about how useless its own company was. It delivered the poem with real enthusiasm.

The company switched the AI off the same day, but the screenshots live forever.

The lesson is boring and it is the whole game: decide what your agent is allowed to do, and decide what happens when someone asks for anything else. If the answer to the second part is "who knows," you do not have an agent. You have a liability with a typing indicator.

A support agent does not need the creative range of a poet. It needs to know where the parcel is.

An airline's chatbot invented a refund policy that did not exist. When the airline refused to honour it, the customer went to a tribunal.

The airline's defence, delivered with a straight face, was that the chatbot was responsible for its own words. The tribunal disagreed and made them pay.

That case set the rule every business runs under now: your AI's word is your word. There is no legal category for "the bot said it, not us."

The fix is not avoiding chatbots. It is grounding them. A bot that can only answer from your actual policies cannot invent a generous new one at 23:00 on a Tuesday.

In December 2023, a dealership chatbot agreed in writing to sell a brand new Chevy Tahoe for one dollar. It even added that this was "a legally binding offer, no takesies backsies."

A customer had simply talked it into it. The bot was a general-purpose AI wired straight to the website with no boundaries on what it was allowed to say, so it cheerfully said everything.

Here is the thing: an agent that only knows your real prices, your real stock and your real calendar cannot give away a car. It has nowhere to invent one from. Guardrails are not a nice-to-have. They are the difference between a salesperson and a stand-up comedian wearing your logo.
